Fair Use Policy

This Fair Use Policy ensures that Orbital's network and infrastructure remain stable, secure, and available to all customers. The policy applies to dedicated hosting, virtual infrastructure, DDoS mitigation, and related network services. Customers are expected to use the Services in a manner consistent with normal commercial, legitimate, and non-disruptive use.

1. Reasonable Use

Customers may use the Service for normal business, website, application, routing, and infrastructure purposes. Reasonable use includes traffic patterns consistent with the service size, billing plan, and network expectations described in the signed order or quote.

2. Traffic Expectations and Usage Levels

Orbital offers hosting and network services designed for legitimate, sustained business and technical use. Most service plans include a baseline traffic allowance that is intended to support normal website, application, routing, and infrastructure traffic. Traffic levels above that baseline may be permitted where they remain consistent with the service plan, the network's operational limits, and reasonable use.

In many cases, the applicable baseline is 32 TB of usage per billing period, subject to the service plan and network conditions. This amount is intended as a practical guideline and soft limit rather than an absolute cap for customers with otherwise normal, compliant traffic patterns.

3. Prohibited Activities

Customers must not use the Services in a way that materially disrupts network performance, interferes with the availability of other systems, or violates applicable law or upstream policy. Prohibited activity includes spam campaigns, phishing, malware distribution, unauthorized access, abuse of IP reputation, excessive resource consumption, or intentional denial-of-service activity.

Third-party infrastructure and network policies may also impose restrictions on DDoS filtering, GRE-tunnel or reverse-proxy use, traffic scrubbing, and other network functions. Where required, these restrictions remain binding even if they are not repeated in this policy.

4. Excessive or Abusive Use

Excessive use includes sustained or unusually high traffic patterns, repeated abuse events, or activity that materially affects the operation of shared infrastructure, other customers, or the integrity of the network. Orbital may monitor usage, identify abnormal or disruptive traffic, and apply corrective action where necessary.

5. Enforcement and Mitigation

Where a customer is in breach of this policy or a materially related operational rule, Orbital may rate limit, redirect traffic, restrict service, suspend or terminate the affected Service, or charge for additional overage or mitigation activity necessary to preserve service stability and compliance. Orbital will generally communicate with the customer where feasible, but immediate action may be required to protect infrastructure, customers, or the public-interest network.

6. Transparency and Policy Updates

We aim to be transparent in how we assess usage, enforce restrictions, and communicate issues to customers. Orbital may update this Fair Use Policy from time to time to reflect technical, legal, or operational changes. Material changes will be communicated through customer notices, website announcements, or account channels as appropriate.
