Fair Use Policy

Orbital, Inc. is committed to providing high-quality services to all our customers. This Fair Use Policy (FUP) applies to our dedicated machines, virtual private servers (VPS), and Layer 4/7 proxy/CDN/WAF/GRE services. It is designed to ensure the integrity, availability, and performance of our network and servers, facilitating an optimal experience for every user.

1. Purpose

1.1 The purpose of this policy is to outline acceptable use of our network resources, particularly focusing on the fair and reasonable use of bandwidth to prevent any potential negative impact on service quality for our customers.

2. Bandwidth Usage

2.1 Reasonable Use: Customers are entitled to reasonable use of available bandwidth across all services, including dedicated machines, VPS, and Layer 4/7 proxy/CDN/WAF/GRE services. Reasonable use constitutes supporting websites, applications, email traffic, and other legitimate activities within the bounds of our bandwidth policy.

3. Bandwidth Policy

3.1 Unmetered Bandwidth: All plans include unmetered 1Gbps usage based on the 95th percentile measurement, applicable to outbound/egress traffic. This allows customers to utilize their service without exceeding the 1Gbps threshold consistently.

3.2 Port Capacity: Services are provided with port capacities ranging from 1Gbps to 40Gbps. Regardless of the port capacity, the unmetered 1Gbps allowance on the 95th percentile applies to outbound/egress traffic.

3.3 Inbound/Ingress Traffic: All inbound/ingress traffic is fully unmetered, regardless of the port capacity/size.

4. Excessive Use

4.1 Excessive use occurs when bandwidth consumption consistently exceeds the 1Gbps threshold, as measured by the 95th percentile. Such usage could potentially affect network performance and the service quality for other users.

5. Monitoring and Enforcement

5.1 Monitoring: Orbital, Inc. actively monitors bandwidth usage to ensure compliance with this FUP.

5.2 Enforcement Actions: Should excessive use be detected, Orbital, Inc. reserves the right to take necessary actions, which may include bandwidth limitation, implementation of corrective measures, or service suspension/termination, to maintain service quality for all customers.

6. Communication and Transparency

6.1 Open Communication: We value transparency and will communicate with customers regarding any data usage concerns before taking enforcement actions.

6.2 Policy Transparency: This FUP is designed to be clear and understandable, ensuring customers are well-informed about their bandwidth usage rights and responsibilities.

7. Policy Changes

7.1 Orbital, Inc. reserves the right to modify this Fair Use Policy. Customers will be notified of any significant changes at least 30 days in advance.
