Terms of Service Policy

Please read these terms of service carefully before using any services provided by Orbital, Inc.. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

1. Application & Agreement

1.1 Acceptance: Orbital, Inc. provides products and services exclusively to customers who have accepted these terms and conditions.

1.2 Governing Law: These terms and conditions are governed by the laws of Canada, specifically Quebec.

1.3 Amendment Rights: Orbital, Inc. reserves the right to modify these terms and conditions at any time without prior notice.

1.4 Agreement Commencement: The agreement between Orbital, Inc. and the customer commences upon sending the order confirmation email.

1.5 Legal Validity: If any part of this agreement is found to be legally invalid, the remainder of the agreement will still apply.

1.6 Accuracy of Information: Customers are expected to provide accurate and truthful information upon registration. Payment information must belong to the customer or their legal ward.

1.7 Marketing Communications: Orbital, Inc. will not send marketing emails without an unsubscribe option and will only send such communications with the customer's consent.

2. Delivery & Obligations

2.1 Delivery Timeline: Orbital, Inc. aims to deliver products within 24 hours, unless otherwise specified.

2.2 Payment Confirmation: Products are delivered only after the corresponding invoice is marked as paid.

2.3 Product Guarantee: We guarantee that our products meet the specifications stated in the offer.

3. Payments & Invoicing

3.1 Payment Terms: Payments must be made according to the terms indicated on the invoice unless otherwise agreed.

3.2 Service Activation: Services may not be activated automatically after payment verification.

3.3 Service Suspension: Services overdue for payment will be automatically suspended.

3.4 Right of Withdrawal: Begins upon service activation and lasts for 14 days, subject to the conditions outlined in our communication policy.

3.5 Custom Services: The right of withdrawal does not apply to custom-ordered services, including but not limited to custom dedicated servers and VPS products.

3.6 Business Customers: The right of withdrawal does not apply to business customers.

4. Intellectual Property

4.1 Content Use: Images, texts, and videos on our platforms are indicative and not grounds for agreement termination or refunds.

4.2 Copyright: Applies to all content provided by Orbital, Inc. across all platforms.

5. Liability

5.1 Service Interruptions: Orbital, Inc. is not liable for damages resulting from service interruptions or maintenance.

5.2 Liability Limit: Our maximum liability will not exceed the value of the purchased service.

6. Force Majeure

6.1 Definition: Includes supplier errors, malfunctions, attacks, natural disasters, and third-party operational issues.

6.2 Agreement Termination: If force majeure persists for over 30 days, both parties may terminate the agreement without reimbursement.

7. Technical

7.1 Server Locations: Our servers are located in various data centers, including but not limited to locations in Canada.

7.2 Backups: Orbital, Inc. performs irregular backups and is not obligated to provide regular backups or data restoration.

7.3 Maintenance: May occur without prior notice, and maintenance-related interruptions are not considered downtime unless specified in our SLA.

7.4 Excessive Use: We reserve the right to suspend services or charge additional fees for excessive usage.

8. Pricing

8.1 Price Indication: Prices on our websites (orbitalsolutions.ca & orbitalsolutions.org) are subject to change and may contain errors.

8.2 Price Adjustments: Any changes to service prices will be applied to subsequent invoices.

8.3 Taxes: Prices exclude applicable taxes for customers outside of Canada.

8.4 Currency: All prices are in Canadian dollars (CAD).

8.5 Price Communication: We will notify customers of price adjustments at least 14 days in advance.

9. Use

9.1 Prohibited Activities: Services must not be used for illegal activities. Users agree to indemnify Orbital, Inc. against any claims arising from such misuse.

9.2 Service Integrity: We reserve the right to take necessary actions to protect our services and comply with legal obligations.

10. Communication

10.1 Official Channels: Include our websites and emails from domains orbitalsolutions.ca and orbitalsolutions.org.

11. Definitions

11.1 Customer: Refers to the individual or entity purchasing services from Orbital, Inc.

11.2 Orbital, Inc.: The business entity operating under the domains orbitalsolutions.ca and orbitalsolutions.org, located at 1337 Haxor Lane, Quebec City, Canada.

11.3 Personnel: Includes all employees and contractors of Orbital, Inc.

11.4 Management: Refers to the executive team of Orbital, Inc.
